1. Acceptance of Terms

By accessing or using the Nepenthes Addict website or purchasing our products, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years old or have the consent of a legal guardian to use our website or purchase products. By using the site, you confirm that you meet this requirement.

3. Products and Services

Nepenthes Addict specializes in the sale of carnivorous plants, plant accessories, and educational content. All products are subject to availability and we reserve the right to limit the quantity of items purchased per person or household.

4. Orders and Payment

All prices are listed in U.S. dollars. Payment must be made at the time of purchase. We accept major credit cards and other methods listed at checkout. Nepenthes Addict reserves the right to cancel or refuse any order for any reason, including product availability, errors in pricing, or suspected fraud.

5. Shipping and Delivery

We ship to addresses within the United States. Estimated delivery times are provided at checkout, but are not guaranteed (outside of priority express which may be refundable if delayed, as detailed by USPS at (USPS.com). Nepenthes Addict is not responsible for delays caused by carriers, weather, or incorrect shipping information provided by the customer. Nepenthes Addict is not responsible for orders that are stolen after delivery (porch piracy), and we are not responsible for orders that are mis-delivered due to incorrect shipping addresses. Customers may purchase insulated packaging materials from us, these materials guarantee live arrival during periods of extreme cold or warm weather, shipments without these materials may be held pending more appropriate weather, customers can request orders without insulated packing materials be shipped immediately during periods of extreme weather, if and only if they fully disclaim Nepenthes Addict from any live arrival guarantees expressed on other shipments.

6. Returns and Refunds

Due to the perishable nature of live plants, all sales are final unless the product arrives damaged or incorrect. We guarantee Healthy and Safe Arrival on all plant shipments, if issues arise we must be contacted within 30 minutes (1/2 hour) from the USPS stamped delivery times. We require this short window to ensure that packages are not left out on your doorstep in the hot sun or freezing cold, as we cannot be held responsible for that. All claims must include supporting photos and a detailed description of what is wrong with the plant. If approved, we may issue a refund, replacement, or store credit at our discretion. We will only approve claims if the damage is severe enough to seriously harm the plant, a broken pitcher or leaf will NOT warrant that. This is a live plant that must be given special conditions, and because of that we only warrant the health of the plant until you receive it, there is no warranty expressed or implied after you start growing the plant. 

7. Intellectual Property

All content on this site, including text, images, logos, and product designs, is the sole property of Nepenthes Addict and protected by copyright and trademark laws. You may not use or reproduce our content without written permission.

8. User Conduct

You agree not to:

Use the site for any unlawful purpose

Attempt to gain unauthorized access to the site or its servers

Post or transmit any content that is abusive, offensive, or misleading
We reserve the right to terminate your access for violations of these rules.

9. Disclaimer of Warranties

Our products and website are provided “as is” and “as available.” Nepenthes Addict makes no warranties or representations, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Nepenthes Addict shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the website or purchase of our products.

11. Privacy

We respect your privacy and take steps to protect your personal information. Please refer to our Privacy Policy for details on how your data is collected, used, and stored.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of Massachusetts.

13. Modifications to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Continued use of the site after such changes constitutes acceptance of the new Terms.
